FISCAL NOTE

Senate Bill 256 as passed the Senate beginning January 1, 2023, provides that probate courts have jurisdiction for will contests which will increase the administrative obligations of the probate courts, by an undetermined amount, dependent upon the number of contested will cases heard by the probate court. This increase could be offset, wholly or in part, by an undetermined amount dependent upon the fees charged for contested will proceedings.

In addition, this bill could increase receipts to the State General Fund, county general funds, and other funds that court fees are distributed to, by an undetermined amount, dependent upon the number of contested will cases that are transferred from the probate court to the circuit court.
