FISCAL NOTE

House Bill 122 as introduced could increase receipts to the State General Fund (presumably) by an undetermined amount dependent on the amount of civil penalties levied against an operator of a train that is stopped at a railroad-highway crossing for more than two hours that impedes emergency vehicles, of $5,000 per hour up to $50,000 per day and the taxes collected from such operator for the costs associated with moving a stopped train, as provided by this bill.

The provisions of this bill could increase the administrative obligations of the Office of Attorney General or a county or municipal governing body, by an undetermined amount, to request an emergency petition against the operator of the train and litigate the matter in court. This increase could be offset if the Attorney General or a county or municipal governing body is successful and is awarded reasonable attorney fees and costs, which could increase the revenues of the Attorney General’s Litigation Support Fund or the county or municipal governing body general fund, by an undetermined amount, depending on the amount of civil fines imposed and reasonable attorney's fees and court costs awarded.
