FISCAL NOTE
House Bill 52 as introduced provides for judicial discretion in determining the length of a revocation sentence and the resplitting of the sentence within the sentence when sentencing defendants for probation revocation under certain conditions. This could decrease the obligations of the Department of Corrections, by an undetermined amount, depending on the number of defendants that violate probation and receive a reduced revocation sentence.
In addition, this bill could increase the obligations of the Board of Pardons and Paroles, by an undetermined amount, depending on the number of defendants sentened to a resplit sentence and released on probation prior to the end of their sentence.
