FISCAL NOTE

Senate Bill 64 as introduced would increase the obligations of the Department of Public Health's Office of Radiation Control (ORC) to license and regulate health care personnel performing radiologic imaging or radiation therapy for diagnostic or therapeutic purposes. This bill authorizes the ORC to set fees and requirements for the issuance of new licenses and renewal licenses, and to assess civil penalties of not more than $200 for a violation of the act or any rule adopted, all of which shall be deposited into the newly established, non-reverting Radiologic Imaging and Radiation Therapy Fund established pursuant to the provisions of this bill. The amount of the increase in the ORCs administrative and financial obligations is undetermined but would be dependent upon the number of persons that would be licensed and regulated as well as the number of violations that occur, which would be offset, wholly or in part, by the license fees and civil penalties deposited into the fund.

This bill will further increase the administrative and financial obligations of the Alabama Department of Public Health by an undetermined amount to administratively support the five member Radiologic Imaging and Radiation Therapy Advisory Committee (established pursuant to the provisions of this bill), in making recommendations and providing guidance on the following: the scope of practice, rules for issuance of licenses, including minimum requirements and issuance and renewal fees, and the denial, suspension and revocation of licenses.
