FISCAL NOTE

Senate Bill 167 as passed the Senate allows a winery, an organization of grape growers and certain other entities to obtain a license, in the amount of $50 from the Alcoholic Beverage Control (ABC) Board, to hold a wine festival. This bill also allows a retailer or manufacturers to obtain a participant license in the amount of $15 from the ABC Board to provide tastings and sell wine for on-premises and off-premises consumption at a wine festival. This bill provides that wine sold at a festival must be taxed in accordance with local, state and federal laws and may not exceed one case of wine per customer per day, which could increase receipts to the Education Trust Fund, State General Fund, the Department of Human Resources, counties and municipalities by an undetermined amount dependent upon the price of the table wine sold by the winery or organization as provided for by law. This bill could also increase receipts to the State General Fund, assuming the license fees are distributed in the same manner as other fees for licenses issued by the board; and would increase the administrative obligations of the Alcoholic Beverage Control Board by an undetermined amount to adopt rules concerning wine festival licensing.
