FISCAL NOTE
Senate Bill 266 as introduced 1) provides an expanded list of crimes that an individual convicted of may petition the sentencing court for DNA testing; 2) revises the standard for petitioning the court for DNA testing; and 3) provides for an appeal for DNA determinations.
This could increase obligations of the State Fair Trial Tax Fund and the Alabama DNA Database Fund, dependent upon the number of petitioners declared indigent and the number of DNA tests that are conducted at private laboratories and the Department of Forensic Sciences.
In addition, this could increase the obligations of various state and local agencies, by an undetermined amount, to assist petitioners in searching and locating evidence to be tested.
