FISCAL NOTE

Senate Bill 365 as introduced requires public K-12 school districts, commencing with the 2022-2023 school year, to: (1) establish an application and acceptance process for resident and nonresident students to apply for enrollment on or before October 1; and (2) adopt policies and procedures, which include, considering a policy to give priority to an applicant with certain proficiency ratings. The provisions of this bill would increase the obligations of a public K-12 school district by an undetermined amount to enroll nonresident students applying for enrollment within the respective school district. However, the increased obligations would be offset, in whole or in part, by the per student share of the net local tax revenue, as determined annually by the State Department of Education (SDE), paid by nonresident students to the enrolling school district upon enrollment.

This bill would increase the obligations of the SDE by an undetermined amount to: (1) evaluate and study the enrollment options throughout the public school system; (2) make enrollment options throughout the public school system available to the public; and (3) provide a report to the Chairs of the Senate Education Policy Committee, the Finance and Taxation Education Committee, the House Education Policy Committee and the Ways and Means Education Committee on or before the 10th legislative day of each Regular Session.
