FISCAL NOTE

House Bill 24 as passed the House of Representatives provides for resentencing of certain individuals convicted of nonviolent crimes, if the covered offense occurred prior to October 1, 2013 and there is evidence that the individual has demonstrated behavior while incarcerated that would indicate his or her fitness for resentencing. In addition, this bill provides that the district attorney in the county of conviction has a right to be heard on any motion filed pursuant to this bill.

This bill could decrease the obligations of the Department of Corrections by an undetermined amount depending on the number of inmates who meet the requirements for resentencing and receive a reduced sentence. In addition, this bill could increase the administrative obligations of the criminal division of circuit court and the district attorney, in the county of conviction, by an undetermined amount to comply with the provisions of this bill.
