FISCAL NOTE

Senate Bill 241 as introduced creates the Alabama False Claims Act which could increase receipts to the State General Fund from civil penalties ranging from $5,500 up to $11,000 for each claim, plus damages sustained by the State and the costs of civil actions brought to recover any penalties or damages.

The bill could also increase the administrative obligations of the Office of the Attorney General by an undetermined amount to carry out the provisions of this bill. The increase in obligations could be offset in total or in part from the recoupment of Medicaid false claims payments from individuals or organizations. Any recoupment in Medicaid funding would be split between the state and the federal government based upon Alabama’s federal medical assistance percentage at the time that the false claim was paid.
