FISCAL NOTE

House Bill 400 as introduced proposes a Constitutional Amendment, which if ratified, would prohibit the state and any political subdivision, and any state official from using public funds or property to enforce any federal act, law, order, rule, or regulation that regulates the possession, use, or manufacture of any firearm, ammunition, or firearm accessory and imposes penalties under certain circumstances. This amendment could increase the obligations of the Office of Attorney General, by an undetermined amount, to seek actions against any political subdivision in the state for violations of this proposed amendment as a result of a valid compliant filed by a resident of that political subdivision; this increase would be offset by a court award for reasonable expenses; and to defend any resident against federal prosecution of violations of federal laws or regulations relating to the in-state manufacture, sale, transfer, or possession of firearms ammunition, or firearm accessories. This amendment could also decrease revenues to any political subdivision of the state that violates this proposed amendment by an undetermined amount dependent on the grants or tax proceeds otherwise received by the political subdivision..

Further, this amendment could increase the proclamation expenses of the Governor, paid from the State General Fund, by an estimated $100,000 for the fiscal year ending September 30, 2023.
