FISCAL NOTE

House Bill 100 as amended and reported by the Committee on Boards, Agencies and Commissions would allow the State Board of Auctioneers to increase, by rule, the licensee fee for an apprentice auctioneer by $50 (not to exceed $150), which could increase receipts to the Alabama State Board of Auctioneers Fund by an estimated $3,000 annually.

Also, this bill would further increase receipts to the fund by an undetermined amount dependent upon the number of individuals that sit for examination, the number and amount of fines assessed from board disciplinary proceedings, and the amount of fees set and collected by the board from the provisions of this bill that allow the board (1) to increase, by rule, examination fees for an auctioneer or apprentice by $50 (not to exceed $150); (2) increase, by rule, the maximum administrative fine for violations resulting from disciplinary actions of the board from $500 currently to $1,500; (3) in injunction cases, to recover a civil penalty of $50 per day for each violation, reasonable attorney fees, and court costs; (4) set fees, by rule, relating to the administration and enforcement of the state board; (5) set a fee, by rule, for an auctioneer to place their license in inactive status; and (6) grant a one-time license and charge a fee, set by the board, to non-resident auctioneers that meet certain requirements.

In addition, this bill could increase the obligations of the board, by an undetermined amount, to hire an investigator and set his or her compensation.
