FISCAL NOTE
House Bill 305 as introduced could increase receipts to the State General Fund for fines imposed as a result of removing the current mandatory sentence of 5-year incarceration with no provision for probation for sale of a controlled substance within a 1,000 foot radius of an educational institution or a place of worship and providing instead a mandatory $250 fine for this crime.
In addition, this bill could increase receipts from fines to the State General Fund by $250 for each person charged with and convicted of the sale of drug paraphernalia within a 1,000 foot radius of an educational institution or a place of worship.
