FISCAL NOTE
House Bill 107 as introduced repeals the Habitual Felony Offender Act and removes references to this act in the Code of Alabama 1975. This bill also provides for any defendant currently in the custody of the Department of Corrections or under the supervision of the Board of Pardons and Paroles or the courts for an offense that he or she was sentenced pursuant to the Habitual Felony Offender Act to be resentenced pursuant to the sentencing standards in place at the time of resentencing.
This bill would 1) decrease the obligations of the Department of Corrections by an undetermined amount dependent upon the number of inmates that receive a reduced sentence; 2) increase the obligations of the Board of Pardons and Paroles by an undetermined amount dependent upon the number of inmates that receive a reduced sentence and are eligible for parole or mandatory release; and 3) increase the obligations of the circuit courts by an undetermined amount dependent upon the number of resentencing hearings held.
